Terms & Conditions
Last Updated: October 14, 2026
1. Introduction
Welcome to Gemetica.
These Terms & Conditions ("Terms") govern your access to and use of the Gemetica website, software platform, and related services (collectively, the "Service").
Gemetica ("Gemetica," "we," "us," or "our") is a software-as-a-service (SaaS) platform designed for jewelry designers, studios, and their clients to present, review, collaborate on, and approve digital jewelry designs.
The Service allows users to upload 3D jewelry models, generate interactive previews, share designs through review links, collect feedback, manage design revisions, and record client approvals.

Legal Entity: NİLİFER KARA ARKAN
Business Address: CAMİİ CEDİT MAH. BEŞ ULALI SK. NO: 14 KULA/ MANİSA/ REPUBLIC OF TÜRKİYE
Country of Establishment: Republic of Türkiye
By creating an account, accessing the Service, or otherwise using Gemetica, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Service.
If you use Gemetica on behalf of a business or organization, you represent that you have the authority to accept these Terms on its behalf.
2. Eligibility
You must be at least 16 years old to use Gemetica.
If you are under the age of legal majority in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian, where permitted by applicable law.
You must have the legal capacity and authority required to enter into these Terms.
You agree to provide accurate information when registering for the Service and to keep that information reasonably up to date.
We may refuse or restrict access where necessary to comply with applicable laws or protect the Service.
3. Description of the Service
Gemetica provides digital tools for jewelry design presentation and collaboration.
Depending on the features available under your subscription, the Service may include:
- Uploading Rhino 3DM and GLB files
- Displaying interactive 3D jewelry previews
- Creating and managing design projects
- Sharing designs through review links
- Collecting client comments and feedback
- Managing design revisions
- Recording design approvals
- Managing project-related collaboration
Gemetica is a design collaboration and visualization platform.
We do not manufacture jewelry, verify the structural integrity of jewelry designs, certify manufacturing specifications, or guarantee that uploaded models are suitable for production.
We may update, improve, modify, or discontinue features, subject to applicable law and any contractual commitments.
4. User Accounts
Certain features require a registered account.
You are responsible for:
- Maintaining the confidentiality of your account credentials
- Using reasonable measures to prevent unauthorized access
- Ensuring information associated with your account is accurate
- Managing access to projects and shared content
- Promptly notifying us of suspected unauthorized account activity
You must not share account access in a way that circumvents subscription restrictions or compromises the security of the Service.
You are responsible for activities conducted through your account to the extent permitted by applicable law.
We reserve the right to suspend access where we reasonably believe an account has been compromised or is being used in violation of these Terms.
5. User Content and Intellectual Property
5.1 Ownership of Uploaded Designs
You retain all ownership rights you hold in the jewelry designs, 3D models, project files, comments, and other materials you upload or submit to Gemetica ("User Content").
Uploading content to Gemetica does not transfer ownership of that content to us.
We do not claim ownership of your jewelry designs.
5.2 License to Operate the Service
By uploading or submitting User Content, you grant Gemetica a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, convert, transmit, and display that content solely as reasonably necessary to:
- Operate and provide the Service
- Generate interactive 3D previews
- Store and manage design projects
- Facilitate review and collaboration
- Display content to authorized recipients
- Maintain security, backups, and technical functionality
- Comply with applicable legal obligations
Rhino 3DM files are converted into GLB format locally within the user's browser. Original 3DM files are not uploaded to or stored on Gemetica's servers. Gemetica stores the resulting compressed GLB files as necessary to provide the Service.
This license does not grant Gemetica ownership of your content or permission to commercially exploit your jewelry designs independently of the Service.
The license ends when the relevant content is deleted from our systems, except to the extent continued processing or retention is reasonably necessary for backups, legal obligations, dispute resolution, or other lawful purposes.
5.3 Responsibility for User Content
You represent and warrant that you have the rights and permissions necessary to upload, process, and share your User Content through Gemetica.
You must not upload content that:
- Infringes another party's intellectual property rights
- Violates applicable laws
- Contains malicious software or harmful code
- Is obtained or shared without necessary authorization
- Is intended to interfere with the operation or security of the Service
You remain responsible for the legality, accuracy, and suitability of your User Content.
5.4 No Transfer of Design Rights to Clients
Viewing, reviewing, commenting on, or approving a jewelry design through Gemetica does not automatically transfer copyright, design rights, or other intellectual property rights to a client or collaborator.
Any transfer or licensing of rights between a designer and a client must be governed by their separate agreement.
5.5 Data Processing Agreement
Where Gemetica processes personal data on behalf of a business customer, such processing is governed by our Data Processing Agreement (DPA), available at https://gemetica.com/docs/dpa, to the extent applicable and agreed between the parties.
The DPA supplements these Terms with respect to the processing of personal data on behalf of business customers.
6. Design Review Links and Sharing
Gemetica enables users to share jewelry designs with clients and collaborators through review links.
Anyone who possesses an active review link can access the associated design and use the available review, feedback, and approval features without creating a Gemetica account or signing in.
Users are responsible for deciding who receives their review links and should share them only with intended recipients.
When a design is archived or deleted, its review link becomes inactive and no longer provides access to the design. Visitors opening an inactive link will see a message indicating that the link is no longer active.
Temporary model-download links issued before a review link becomes inactive may remain valid until they expire, currently for up to five minutes, unless the model file is removed earlier. Deactivating a review link does not remove copies, screenshots, or recordings already obtained by a recipient.
Users acknowledge that:
- Active review links may be forwarded or shared by recipients.
- The confidentiality of a shared design depends partly on how recipients handle access to the link.
- Recipients may capture screenshots, recordings, or other representations of content they can view.
- Gemetica does not independently verify the identity of every person accessing a review link.
We do not guarantee that internet-based sharing can prevent all unauthorized copying, disclosure, or redistribution.
To the extent permitted by applicable law, Gemetica is not responsible for unauthorized disclosure resulting from a user's decision to share a review link publicly or with an unintended recipient.
7. Client Feedback, Revisions, and Approvals
Gemetica provides tools for collecting client feedback, managing revisions, and recording design approvals.
These tools are intended to facilitate communication and documentation between jewelry designers and their clients.
7.1 Feedback and Comments
Users and invited collaborators may submit feedback, comments, or revision requests.
The designer or studio remains responsible for interpreting feedback, implementing requested changes, and confirming the final design specifications.
7.2 Design Approvals
An approval recorded through Gemetica indicates that an approval action was submitted in relation to the associated design or revision.
Gemetica does not independently verify that the individual submitting an approval has the legal authority to approve a design on behalf of another person or organization.
Unless separately agreed between the designer and client, an approval recorded in Gemetica does not automatically:
- Constitute a legally binding purchase order
- Authorize manufacturing or production
- Transfer intellectual property ownership
- Confirm payment obligations
- Establish a warranty regarding the finished jewelry
- Replace a separate design, manufacturing, or sales contract
Whether an approval creates binding obligations between a designer and client depends on their agreement, the surrounding circumstances, and applicable law.
7.3 Manufacturing Responsibility
Gemetica does not verify:
- Gemstone dimensions or tolerances
- Structural strength or durability
- Metal thickness or production feasibility
- Stone-setting suitability
- Manufacturing accuracy
- Material costs or product safety
- Compatibility with specific manufacturing equipment
Designers and manufacturers are responsible for validating models and specifications before production.
8. Subscriptions and Payments
Certain Gemetica features may require a paid subscription.
Subscription plans, pricing, billing intervals, and included features are displayed through the Service or its applicable checkout process.
8.1 Payment Processing
Paid subscriptions and additional storage purchases are not currently available. Gemetica intends to use Paddle to process subscription payments when paid purchases are enabled.
Paddle may act as the merchant of record for transactions and may be responsible for collecting payments, calculating applicable taxes, and issuing relevant billing documents.
Payments are subject to applicable Paddle checkout terms and policies.
8.2 Recurring Billing
If you purchase a recurring subscription, your subscription will generally renew at the end of each billing period unless canceled in accordance with the applicable subscription terms.
By purchasing a recurring subscription, you authorize the applicable payment processor to charge the subscription fees disclosed at checkout.
8.3 Subscription Cancellation
You may cancel a subscription using the cancellation method made available through your account or by contacting us at contact@gemetica.com.
Unless otherwise stated at checkout or required by law, cancellation stops future renewals, and access to paid features continues until the end of the current paid billing period.
8.4 Refunds
Refund eligibility is governed by applicable law, the terms disclosed at checkout, and any applicable Paddle refund policies.
Nothing in these Terms limits statutory cancellation, withdrawal, or refund rights that cannot legally be excluded.
8.5 Pricing Changes
We may change subscription prices from time to time.
Where required by law or contract, we will provide advance notice of changes affecting existing subscriptions and any applicable cancellation options.
9. Free Access and First Design
Gemetica offers eligible new users a one-time opportunity to create and share their first jewelry design project free of charge.
Free access includes:
- A maximum input file size of 50 MB per upload.
- A total storage allowance of 250 MB.
- One review link creation, available only once per eligible user.
The free review link allowance is consumed when the user creates their first review link. Archiving or deleting that link does not restore the allowance.
Gemetica may also provide a sample design for demonstration purposes. The sample design does not consume the user's one-time free review link allowance.
Free access does not automatically convert into a paid subscription. Users will not be charged unless they actively select a paid subscription and complete the applicable checkout process.
Paid subscriptions are subject to the pricing, billing, cancellation, and refund terms disclosed through the Service.
9.1 One-Time Free Allowance and Re-Registration
The free usage allowance is intended as a one-time benefit for each eligible user, not a renewable trial.
Deleting an account and creating a new account using the same email address does not automatically restore the free allowance.
To prevent repeated redemption, Gemetica may retain a limited record of previous free allowance usage, including a protected, pseudonymized email-derived identifier, as described in our Privacy Policy.
Eligibility checks based on retained records apply only for as long as those records are lawfully maintained. After the applicable retention period expires, Gemetica may no longer be able to identify previous use of the allowance through that record.
Gemetica may correct eligibility errors or grant additional free access at its discretion.
9.2 Changes to Free Access
Gemetica may modify free access limits for future users, subject to applicable law and any commitments already made.
10. Acceptable Use
You agree not to misuse Gemetica.
Prohibited activities include:
- Accessing another user's account or private content without authorization
- Attempting to bypass authentication or access controls
- Distributing malware or malicious files
- Using automated systems to overload or disrupt the Service
- Exploiting security vulnerabilities
- Uploading unlawful or infringing content
- Using the Service for fraud or deceptive activity
- Circumventing subscription or usage restrictions
- Interfering with other users' ability to access the Service
- Reverse engineering the Service in violation of applicable law
We may investigate suspected violations and take proportionate action, including restricting access, removing unlawful content, or suspending accounts.
11. Storage and File Availability
Gemetica uses third-party cloud infrastructure to store and deliver uploaded files.
Although we aim to provide reliable storage and access, we do not guarantee uninterrupted availability or permanent preservation of uploaded content.
Users should maintain independent backups of important jewelry design files.
We are not intended to serve as the sole archival storage location for valuable or irreplaceable design assets.
Storage allowances and technical limitations may vary by subscription plan.
We may restrict files that exceed applicable limits or pose security or operational risks.
12. Third-Party Services
Gemetica relies on external providers to deliver certain functions.
These include:
- Cloudflare Pages for website hosting
- Supabase for authentication, database, and backend services
- Cloudflare R2 for 3D file storage
- Resend for transactional email delivery
- Paddle for subscription billing
- Cloudflare Web Analytics for website analytics
Certain service functions may depend on the continued availability of these providers.
We are not responsible for every interruption or failure originating from independent third-party systems, but this does not exclude responsibility imposed on us by applicable law.
13. Privacy and Data Protection
Your use of Gemetica is also governed by our Privacy Policy, available at:
https://gemetica.com/docs/privacy
Our Privacy Policy describes how we collect, use, store, and disclose personal information.
By using the Service, you acknowledge that your personal information may be processed as described in that policy.
Where Gemetica processes personal information on behalf of a business customer, additional data processing terms may apply.
14. Confidentiality
Gemetica recognizes that uploaded jewelry designs and project materials may contain confidential business information.
We will process such content for the purposes of operating the Service, subject to these Terms, our Privacy Policy, and applicable law.
Users remain responsible for establishing appropriate confidentiality agreements with clients, contractors, manufacturers, and other collaborators when necessary.
Gemetica does not automatically create a nondisclosure agreement between users or between designers and clients.
15. Service Availability and Changes
We aim to provide a reliable and functional platform.
However, the Service may occasionally be unavailable due to:
- Scheduled maintenance
- Technical problems
- Infrastructure failures
- Security incidents
- Third-party service interruptions
- Circumstances beyond our reasonable control
We may modify the Service to improve performance, introduce features, address security risks, or comply with legal requirements.
Where changes materially and adversely affect paid functionality, we will provide any notice or remedies required by applicable law or contract.
16. Account Deletion
Users may delete their Gemetica accounts through the account settings page at https://gemetica.com/app/settings.
Any associated paid subscription must be in a confirmed canceled status before account deletion can be completed. Account deletion may be blocked while a subscription remains uncanceled. Users can cancel through available billing management options or contact contact@gemetica.com for assistance. Requesting account deletion does not itself replace subscription cancellation.
Account deletion also initiates the removal of associated projects, stored 3D design files, review links, and related account information, subject to applicable legal retention requirements and technical limitations.
Deleted designs will no longer be accessible through their review links.
Users should retain independent copies of important design files before deleting their accounts.
Account deletion does not automatically entitle users to a refund of subscription fees already paid. Any applicable refund rights remain governed by our Refund Policy, Paddle's applicable terms, and mandatory law.
17. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Gemetica is provided on an "as available" and "as is" basis.
We do not warrant that the Service will always be uninterrupted, error-free, or compatible with every file, device, browser, or manufacturing workflow.
In particular, Gemetica does not guarantee that:
- Uploaded 3D models are technically accurate
- Previews perfectly represent manufactured jewelry
- Every 3DM or GLB file will render without errors
- Design approvals will eliminate misunderstandings between parties
- Uploaded content will be permanently available
- The Service will meet every user's specific business requirements
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Gemetica and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, business opportunities, or anticipated savings arising from use of the Service.
This includes, where legally permitted, losses associated with design disputes, manufacturing decisions, unauthorized sharing by users, or service interruptions.
Subject to applicable law, our total aggregate liability arising out of or relating to the Service will not exceed the subscription fees paid for the affected account during the 12 months preceding the event giving rise to the claim.
For users who have not paid subscription fees, liability will be limited to the maximum extent permitted by applicable law. No monetary liability cap is specified for such users under these Terms.
These limitations do not apply to liability that cannot legally be limited or excluded, including liability for fraud, willful misconduct, or other non-excludable obligations under applicable law.
19. Indemnification
To the extent permitted by applicable law, business users agree to indemnify and hold harmless Gemetica and its operator against third-party claims, damages, and reasonable expenses arising from:
- User Content that infringes third-party rights
- Unlawful use of the Service
- Material violations of these Terms
- Unauthorized distribution of third-party confidential information
This obligation applies only to the extent the relevant claim results from the business user's conduct and does not arise from Gemetica's own wrongful acts or omissions.
This section does not limit mandatory consumer protections.
20. Intellectual Property of Gemetica
The Gemetica platform, including its software, interface, branding, logos, website content, and underlying technology, is owned by Gemetica or its licensors, subject to applicable intellectual property laws.
These Terms grant you a limited, non-exclusive, non-transferable right to access and use the Service in accordance with your subscription and these Terms.
You may not reproduce, distribute, sell, or commercially exploit Gemetica's proprietary software or branding without appropriate authorization.
This section does not affect your ownership of User Content.
21. No Professional or Manufacturing Advice
Gemetica is a software tool and does not provide engineering, manufacturing, legal, financial, or professional certification services.
Any visualizations, comments, revision records, or approvals generated through the platform are provided for collaboration and informational purposes.
Users are responsible for obtaining appropriate professional advice and performing necessary technical verification before relying on designs for manufacturing or commercial transactions.
22. Force Majeure
Neither party will be responsible for delays or failures in performance caused by events beyond its reasonable control, to the extent permitted by applicable law.
Such events may include natural disasters, widespread network outages, government restrictions, major infrastructure failures, or other extraordinary circumstances.
This provision does not excuse payment obligations already due or override non-excludable legal rights.
23. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Türkiye, excluding conflict-of-law rules where legally permitted.
To the extent permitted by applicable law, disputes arising from these Terms will be subject to the jurisdiction of the competent courts and enforcement offices in Manisa, Republic of Türkiye, except where mandatory consumer protection laws or other applicable jurisdictional rules provide otherwise.
Nothing in these Terms deprives consumers of protections or access to courts that cannot legally be waived.
Before initiating formal proceedings, parties are encouraged to contact us at contact@gemetica.com to seek an informal resolution.
24. Changes to These Terms
We may update these Terms to reflect changes in our Service, business operations, or applicable laws.
When updated, the revised Terms will be published on our website with a new "Last Updated" date.
Where required by law or contract, we will notify users of material changes and provide appropriate options.
Continued use of the Service after legally effective changes may constitute acceptance where permitted by applicable law.
25. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
26. Entire Agreement
These Terms, together with any applicable subscription terms, incorporated policies, and separately executed agreements, constitute the agreement governing use of Gemetica.
Where a separately executed agreement expressly conflicts with these Terms, that agreement will control to the extent specified in it.
